Eligibility:
Golden Island Spark Your Summer Sweepstakes (the “Sweepstakes”) is open to U.S. residents 18 years of age and older as of September 8, 2023. Proof of age and identity must be furnished upon request. Employees, agents, independent dealers, and affiliates of Sponsor (identified below) and its agents, affiliates, and immediate family members of all such persons, are not eligible to participate in Sweepstakes. Sponsor reserves the right, at its sole discretion, to cancel, terminate, suspend, or amend this Sweepstakes at any time for any reason. Sponsor further reserves the right to amend these rules (“Official Rules”) at any time without prior notice, at its sole discretion. Sponsor reserves the right to disqualify any participant for any reason, including, but not limited to, violation of these Official Rules, copyright infringement or infringement of the rights of a third-party.

Agreement to Rules:
By submitting an entry, participant agrees to be fully and unconditionally bound by these Official Rules and represents and warrants that he or she meets the eligibility requirements set forth herein. In addition, participant agrees to accept the decisions of Sponsor, as final and binding as they relate to the content and Sweepstakes. The Sweepstakes is subject to all applicable federal, state and local laws. Persons submitting incomplete entries or entries under false pretenses will be disqualified.

Sweepstakes Period:
Entries will be accepted online starting on September 8, 2023 at 10 AM CST and ending on September 13, 2023 at 10 AM CST. All online entries must be received by September 13, 2023 at 10 AM CST.

How to Enter:
Beginning September 8, 2023, participants may enter the Sweepstakes by commenting on Golden Island’s Instagram specific Spark Your Summer sweepstakes post (goldenislandjerky) and following @goldenislandjerky. Additional entry for sharing the specific post to user’s Instagram Story. Participants may leave as many unique comments as desired to increase the chance of winning. Duplicate entries from the same Instagram username, email address, person, or household may be eliminated without notice to the participant. Use of any robotic, automatic, programmed, or similar entry method or entering more than the number of times permitted will void all entries and result in disqualification.

Prize:
There will be one (1) winner who will receive one prize consisting of one (1) set of cornhole boards, one (1) Golden Island t-shirt, one (1) bag of Korean Barbecue Recipe Pork Jerky, one (1) bag of Korean Barbecue Recipe Pork Snack Bites, one (1) koozie, one (1) fanny pack, one (1) bucket hat, one (1) pair of sunglasses, two (2) sticks and two (2) pins. Valued at $130. The specifics of the prize shall be solely determined by the Sponsor. No cash or other prize substitution permitted except at Sponsor’s sole discretion. Sponsor reserves the right to substitute a prize of equal or greater value. The prize is non-transferable. Any and all prize related expenses, including without limitation any and all federal, state, and/or local taxes shall be the sole responsibility of the winner. Acceptance of prize constitutes permission for Sponsor to use winner’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.

Odds:
The odds of winning depend on the number of eligible entries received.

Winner Selection and Notification:
The potential winners of the Sweepstakes will be selected in a random drawing under the supervision of the Sponsor conducted on or about September 13, 2023. Potential winners will be notified via direct message (DM) within five (5) days following the selection. Sponsor shall have no liability for a potential winner’s failure to receive notices due to any reason. If the potential winner cannot be contacted, is ineligible, fails to claim the prize within fifteen (15) days from the time award notification was sent, or fails to timely return a completed and executed declaration and releases, as required, prize may be forfeited, and an alternate winner may be selected. To accept and receive the prize, the potential winner must: a) provide personal and contact information to Sponsor, including proof of age, full name, and address, and if necessary for tax purposes, social security number; b) if required by the IRS, complete and return a W-9; and c) execute any other documents specified by Sponsor, in its sole discretion, by the deadlines specified.
The receipt by winner of the prize offered in this Sweepstakes is conditioned upon compliance with any and all federal and state laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AT SPONSOR’S SOLE DISCRETION) WILL RESULT IN SUCH WINNER’S DISQUALIFICATION AS WINNER OF THE SWEEPSTAKES AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

Rights Granted by Participant:
By entering, participant agrees that Sponsor, anyone acting on behalf of Sponsor, or its respective licensees, successors and assigns will have the right, where permitted by law, without any further notice, review or consent to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the World, participant’s entry, including, without limitation, the entry and winner’s name, portrait, picture, voice, likeness, image or statements about the Sweepstakes, and biographical information as news, publicity or information and for trade, advertising, public relations and promotional purposes without any further compensation.

Terms:
Sponsor reserves the right, in its sole discretion to cancel, terminate, modify, or suspend the Sweepstakes should (in its sole discretion) a civil, environmental, or public health emergency, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness, or proper conduct of the Sweepstakes. Sponsor reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Sweepstakes or website or violates these Official Rules.
Any attempt by a participant to deliberately damage any website or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law.

Limitation of Liability:
By entering this sweepstakes, participant agrees to release and hold Sponsor, its employees, officers, directors, shareholders, agents, representatives, parent companies, affiliates, subsidiaries, advertising, promotion and fulfillment agencies, and legal advisors, as well as any entity associated with the brands comprising the prize, (the “Released Parties”), harmless from any and all losses, damages, rights, claims and actions of any kind (including attorneys’ fees) arising out of or in connection with the Sweepstakes or the acceptance, use, or misuse of any prize, including without limitation, personal injury, death and property damage, and claims based on publicity rights, defamation, or invasion of privacy. Released Parties are not responsible for errors or difficulties of any kind whether human, mechanical, technical, electronic, computer, network, typographical, or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the prizes, or in any Sweepstakes-related materials. In addition, by participating in this Sweepstakes participant agrees to a complete release of Meta, Facebook, and/or Instagram of any claims.

Disputes:
This Sweepstakes is governed by the laws of the State of Minnesota, without respect to conflict of law doctrines. As a condition of participating in this Sweepstakes, participant agrees that any and all disputes which cannot be resolved between the parties and causes of action arising out of or connected with this Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Hennepin County, Minnesota. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys’ fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Sweepstakes), and participant further waives all rights to have damages multiplied or increased.
